Present — Hagarty, Acting P.J., Carswell, Johnston, Aldrich and Nolan, JJ.


In an action for a declaratory judgment as to the effect upon a separation agreement of defendant's remarriage, and for other relief, plaintiff appeals (a) from so much of an order as dismisses his first cause of action, and (b) from an order denying his motion for an injunction pendente lite. Orders, insofar as appealed from, unanimously affirmed, with $10 costs and disbursements. No opinion.
