ORDER


THIS CAUSE is before the Court upon Defendant's Motion for Summary Judgment (DE#18) and Plaintiffs Response Thereto (DE#19).

THE MATTER was referred to the Honorable Frank J. Lynch, Jr., United States Magistrate Judge. A Report and Recommendation dated February 26, 2002 has been filed, recommending that Defendant's Motion for Summary Judgment be GRANTED as to both Plaintiff's 26 U.S.C. § 7426 (h)(1) claim for damages and as to Plaintiffs claim for a full refund. The Magistrate also recommends that Plaintiffs claim for a partial refund for a yet to be confirmed amount of $1,678.00 be GRANTED on summary judgment, as agreed to by the Defendant.

A review of the record shows that the parties have not filed objections to the Magistrate's Report. Accordingly, after a de novo review of the record herein, and being otherwise fully advised in the premises, it is

ORDERED AND ADJUDGED that United States Magistrate Judge Lynch's Report and Recommendation be, and the same is, hereby ADOPTED in its entirety. This case is CLOSED. All pending motions are DENIED AS MOOT.
