Supreme Court of Colorado. En Banc

65 P.2d 710 (Colo. 1937)

Opinion

No. 13,896.

Decided February 15, 1937. Rehearing denied March 8, 1937.

Suit involving contract for publication of Colorado Statutes, Annotated. Judgment for defendants.

Affirmed.

1. APPELLATE PROCEDURE — Divided Court. One justice not participating and the others being equally divided in opinion as to what disposition should be made of the case, the judgment is affirmed by operation of law.

Error to the District Court of the City and County of Denver, Hon. Frank McDonough, Sr., Judge.

Mr. S. HARRISON WHITE, Mr. WINTHROP BOSLEY, Mr. WILLIAM H. COURTRIGHT, for plaintiff in error.

Mr. PAUL P. PROSSER, Attorney General, Mr. FRANK L. HAYS, Mr. JOE H. ROSS, Mr. WILBUR F. DENIOUS, Mr. HUDSON MOORE, Mr. DAYTON DENIOUS, for defendants in error.

This case has been heard and considered, Mr. Justice Knous not participating. Mr. Chief Justice Burke, Mr. Justice Bouck and Mr. Justice Bakke are in favor of affirmance, whereas Mr. Justice Hilliard, Mr. Justice Young and Mr. Justice Holland are in favor of reversal. As the case therefore stands affirmed by operation of law because of an equally divided court (Code '21, § 439), no good purpose would be served by a statement of the issues or of the reasons for the conclusions of the several members of the court.

Judgment affirmed.
