HIGHWAYS AND STREETS, § 459slight depression of portion of sidewalk not actionable defect. In action against city, adjacent property owners and plumber, who had made repairs on behalf of property owners necessitating removal of portion of sidewalk, to recover damages resulting from fall thereon, judgment for defendants notwithstanding verdict was justified where depressed area in sidewalk, allegedly causing fall, was about 1 1/2 inches or smaller and reasonably safe as matter of law.

Appeal from the Circuit Court of Madison county; the Hon. EDWARD F. BAREIS, Judge, presiding.
