Opinion

Gen. No. 44,320. (Abstract of Decision.)

Opinion filed March 29, 1948 Rehearing denied April 9, 1948 Released for publication April 9, 1948

EXAMINATION OF WITNESSES, § 100reversible cross examination of plaintiff in automobile accident case. Where defendant, in action for personal injuries allegedly sustained in automobile accident, failed to show that worry caused by plaintiff's marital difficulties with her husband tended to cause or aggravate ailments of plaintiff of which she complained, cross examination of plaintiff, over objections, regarding her marital difficulties was prejudicial as calling for immaterial and irrelevant matters and warranted reversal of judgment for defendant.
