Beery v. Breed

Appellate Court of Illinois
Feb 14, 1941
309 Ill. App. 433 (Ill. App. Ct. 1941)

Opinion

Gen. No. 9,621. (Abstract of Decision.)

Opinion filed February 14, 1941. Rehearing denied April 2, 1941.

AUTOMOBILES AND MOTOR VEHICLES, § 115driving on wrong side of road, evidence. In action for injuries sustained by plaintiff when the car in which she was riding was involved in a head-on collision with the car owned by defendant's intestate, evidence supported judgment for plaintiff, where it appeared that defendant's car was driven on the wrong side of the road, and that plaintiff's husband who was driving turned to his right onto the shoulder of the road in a vain attempt to avert the collision, and plaintiff's instructions were not erroneous as unduly emphasizing the duties of intestate and the driver of her car and making no reference to the duties plaintiff and her driver.

Appeal from the Circuit Court of Henry county; Hon. LEONARD E. TELLEEN, presiding.

Affirmed. Heard in this court at October term, 1940.

Thomas J. Welch and Vera M. Binks, for appellants;

James H. Andrews, Gregg A. Young and Harper Andrews, for appellee.
