ORDER ACCEPTING FINDINGS AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE

Pursuant to 28 U.S.C. § 636, the Court has reviewed the Third Amended Complaint (“TAC”), Defendant Deputy Kristy Erwin's (“Defendant”) Amended Motion for Summary Judgment (“MSJ”), the relevant documents on file, and the Report and Recommendation (“R&R”) of the United States Magistrate Judge. Electronic Case Filing Number (“ECF No.”) 86, TAC; ECF No. 115, MSJ; ECF No. 129, R&R. No objections have been filed. The Court accepts the findings and recommendation of the Magistrate Judge.

IT IS THEREFORE ORDERED that Defendant's MSJ is DENIED. 1
