Bailey v. Ohio Dept. of Rehab. Corr

Court of Claims of Ohio
Sep 10, 1990
62 Ohio Misc. 2d 19 (Ohio Misc. 1990)

Opinion

No. 89-11139-AD.

Decided September 10, 1990.

Dennis Bailey, pro se.

On August 28, 1990, plaintiff filed a motion for court review wherein he challenged the deputy clerk's August 7, 1990 decision denying plaintiff's request for filing fee and postage cost reimbursement. R.C. 2335.19 provides in part that "on the rendition of judgment, in any cause, the cost of the party recovering, together with his debt or damages, shall be carried into his judgment." Costs do not include postage, but do include the $15 filing fee plaintiff was required to post. Accordingly, plaintiff's motion for court review is SUSTAINED and defendant is ORDERED to pay plaintiff $22.40 plus $15 in costs plus such interest as is allowed by law.

So ordered.

RUSSELL LEACH, J., retired, of the Franklin County Municipal Court, sitting by assignment.
