Arbelaez v. State

Supreme Court of Florida
Sep 19, 2011
Case No. SC10-1038 (Fla. Sep. 19, 2011)

Opinion

Case No. SC10-1038.

September 19, 2011.

Lower Tribunal No(s). 88-5546.

Guillermo Octavio Arbelaez filed a successive postconviction motion in which he raised claims based on Atkins v. Virginia, 536 U.S. 304 (2002). The postconviction court denied the motion after an evidentiary hearing. We hereby affirm the postconviction court's denial of relief. Arbelaez did not prove that he has concurrent deficits in adaptive behavior as required by section 921.137(1), Florida Statutes (2004), and Florida Rule of Criminal Procedure 3.203(b).

CANADY, C.J., and PARIENTE, LEWIS, QUINCE, POLSTON, LABARGA, and PERRY, JJ., concur.
