MAIN, Justice (concurring in part and dissenting in part).

On November 17, 2011, this Court granted the writ of certiorari as to issue 1 and issue 20 in Benito Ocampo Albarran's petition. I concur in quashing the writ as to issue 20. However, because I would consider issue 1, I dissent from this Court's order insofar as it quashed the writ as to that issue.

Justice Wise was a member of the Court of Criminal Appeals when that court considered this case.
