Opinion

Gen. No. 43,543. (Abstract of Decision.)

Opinion filed November 20, 1946 Rehearing denied December 4, 1946 Released for publication December 5, 1946

EVIDENCE, § 684.1admissibility of Federal Trade Commission's cease and desist order directed against plaintiff. It was prejudicial error as to plaintiff, in action to recover balance due under contract for training course in air conditioning and refrigeration, to admit in evidence Federal Trade Commission's cease and desist order charging plaintiff with unlawful practices in deceiving its customers by false representations, since order had no bearing on issues in case and was not competent to prove facts which defendant had burden of proving.
